Brazil after the betting ban. Player funds now take centre stage
AT A GLANCE

Key information

  • The scheduled bank-refund window of 9-14 October has ended.
  • BRL 1.325 billion is the initial amount covered by the process, not a confirmed outstanding balance.
  • The ministry’s newer FAQ identifies 15 October as the start of Caixa’s intermediary role in more difficult cases.

Brazil’s scheduled bank-refund window for money held on platforms covered by the ban ran from 9 to 14 October and has now ended. That does not confirm that every customer has received their funds. Attention now turns to unresolved cases and the next stage of the refund process.

According to Agência Brasil, the procedure initially covered approximately BRL 1.325 billion left in customer accounts. This is the amount subject to the settlement process, not a confirmed total still awaiting repayment on 15 October. The distinction matters: the expiry of a deadline is not a substitute for evidence of completed transfers. [4]

What did the ban change?

Published on 25 September, Provisional Measure No. 1,394/2026 prohibited operating, offering and advertising fixed-odds betting, covering sports betting and the online games specified in the legislation. It also applies to overseas operators serving people located in Brazil. Other legally permitted forms of lottery remain subject to separate rules. [1]

For customers, the closure timetable was central. Voluntary withdrawals through platforms were scheduled to remain available until 5 October. Websites and applications covered by the rules were to be taken offline the following day. Financial institutions then took over the remaining refunds. [2]

The change also covers marketing and sponsorship promoting the prohibited offering. It therefore affects operators, publishers, affiliates and advertising partners directing those activities at Brazilian audiences. The rules concern specified services and their promotion; they should not be equated with a ban on all reporting about the industry. [1]

The bank deadline leaves more difficult cases

The Ministry of Finance FAQ updated on 7 October identifies 15 October as the start of Caixa Econômica Federal’s intermediary role in cases where operational obstacles prevented banks from returning funds. We cite this date from the ministry’s more recent timetable. The FAQ entry alone does not confirm that every payment has begun or that the overall process is complete. [2]

The rules cover available balances, winnings owed and the return of stakes on bets declared void under the closure procedure. Funds intended for repayment must remain separate from the operator’s assets. Ending operations does not remove the company’s responsibility for missing funds or settlement discrepancies. [1]

For customers, the outcome of their individual settlement matters most. For the market, aggregate figures are needed: how much has been returned, how many cases remain open and which obstacles persist. The cited materials do not confirm that the entire amount has already been repaid.

The industry also awaits further decisions

A provisional measure has the force of law from its entry into effect, but its permanent continuation requires consideration by Congress within the prescribed period. As Brazil’s Senate explains, the current stage does not mean that the legislative process is finished. [3]

Our assessment: the most useful measure of the market-closure process will now be completed settlements and clear communication with customers. Headlines about a large sum or an expired deadline do not establish whether an individual customer has recovered their money. Further developments should be assessed against confirmed refunds and new decisions by the authorities.
